I'm no hypocrite - God knows that I've downloaded most of my rare recordings and that includes official stuff. I have the game, picked it up at a ridiculously low price in Johannesburg shortly after it was released, but if I didn't have it I'd gladly download it.

You are part right; in context, the phrases are correct. Stand-alone, a wrong version of the coniunctivus is used (in fact, it ought to be avoided in stand-alone altogether) in the latter quote, and a contextualized version of a participium clause is used in the former.
