A MESSAGE TO ALL NEW OR CURRENT MEMBERS ABOUT THE POLICIES BY QUEENZONE ABOUT OR IN REGARDS TO OFFICIAL QUEEN MEDIA AND DOWNLOADS: We have a policy on this board that in effect should be adhered to AT ALL TIMES in order to maintain a website where we can otherwise talk freely and such, and that is: NO UPLOADING OF *OR* STREAMING OF *OR* POSTING LINKS TO OFFICIAL VIDEOS OR AUDIO CONTENT OF OFFICIALLY RELEASED QUEEN MEDIA. That means no posting links to websites or locations (whether HTTP or FTP) where the following can be either downloaded, streamed, listened to, or watched: -Any songs in MP3, AAC, FLAC, APE, RealMedia (RM), or any audio format that can be converted to CD Audio (or otherwise) or played on an audio device or system, that have been taken from officially released audio formats. This includes songs that have been released on a Queen (or related) album, single, compilation, soundtrack, video, LaserDisc, etc., regardless of whether they are or have been on sale, or were promotional items, etc. This also includes audio downloads from services such as 7Digital, iTunes, and the like. And needless to say, even though we WOULD like to think that songs or items exclusive to one country (be it Italy, Japan, Canada, or wherever) are free of copyright laws and restrictions outside of that particular country or countries, that is almost never the case at all. In fact, it is NEVER the case at all. And it also includes any leaked or prereleased (i.e. review/press copies) audio content that is KNOWN or CONFIRMED to be included on an upcoming OFFICIAL RELEASE. Next: -PROMOTIONAL MUSIC VIDEOS that have been released on officially licensed videotapes, LaserDiscs, DVD's, Betamax, or any video content. It also includes videos or alternate versions of videos that have never been or yet to be released on a video format, that HAVE been or IS being currently shown on television. This also includes official promotional DVD's such as Greatest Flix I&II. Videos that HAVE been released CANNOT be even streamed here, or have links posted to a stream, whether it is not downloadable or not. There is a reason or two, or maybe even more, that we have these policies in effect, in case you need reminding or worse: -MOST IMPORTANT: Due to recent illegal download services such as Napster, KaZaA, and the like, many record labels and their lawyers, representatives, services, etc., have been taking harsh methods possible to fine and/or charge people and services that encourage and/or participate in these illegal acts of downloading officially released material, whether in MP3 form or not, and are also shutting down many websites that offer official MP3's, whether intentionally or not (usually, they are fair to give one or two warnings at best to the service providers or webmasters). It is for that reason that we are TRYING our best to keep this site well alive and running, so that we have an otherwise unmoderated place to be able to talk freely, participate in discussions, share other things, and such things, rather than to encourage illegal downloading that COULD and CAN get this website permanently shut down, which would be a very upsetting loss to many on this board, especially us older and long-remaining (as well as some more recent) posters and members of this board. -Another reason, relating to the first one above, is that this site is VERY well known to not only Queen fans, but Queen productions and their associates alone (TRUST me when I say this...I know it for a fact myself...and NO I'm not one of them). If Queen Productions know or get tipped off that many people are encouraging downloads or downloading of official material that ends up losing them potential income, whether small or large, then they could and WILL take action against this site. I believe we so far have been lucky that they haven't, and we hope that it continues that way. Now, to end this post on a different note |

From reading this notice board, you complain the most about it. It's not like they won't find them. And I don't think the links have been deleted, probabably because they are on link and not QZ. But I agree with what you said, but I think mods should take care of it. |

Dear Inu-Liger I know you like your CAPS LOCK key on your keyboard, but read this reply carefully! Read also my post in the announce forum. I started this discussion because one day some company/organisation WILL proceed on taking action ... It's just a simple warning/advice for all of us .... regarding the the 1st post you made: Quote: "Now, to end this post on a different note, I am also going to point out that downloading of the FOLLOWING media is acceptable under this website's rules and conditions: -Audio or video bootlegs of concerts that have been recorded by fans or that have come from soundboard sources (EXCEPT for shows that have been officially released by QP/EMI and such, on any of the above listed media formats, whether in part or whole)" End Quote the legal answer is: " Bootleg recordings are musical recordings that have not been officially released by the artist or their associated management or production companies. They may consist of demos, outtakes or other studio material, or of illicit recordings of live performances. Music enthusiasts may use the term "bootleg" to difsupidferentiate these otherwise unavailable recordings from "pirated" copies of commercially released material, but these recordings are still protected by copyright despite their lack of formal release, and their disstupidtribution is still against the law" source : link "Definitions Here are the proper definitions of the terms according to American Heritage dictionary: Copy: a reproduction of the original Pirate: the use of stolen intellectual property of another Counterfeit: an inferior duplication made to defraud Bootleg: Product produced without permission source: link and: "The slang term bootleg (derived from the use of the shank of a boot for the purposes of smuggling) is often used to describe illicitly copied material. "In December, 1994, Congress changed the law of unrecorded music performances when it passed The Uruguay Round Agreements Act. This act included a new provision, which prohibited the recording of live musical performances (that is, bootleg copies) even when there was no other "fixation" of the work. This provision includes separate prohibitions against the distribution and transmission of bootleg copies. In fact, the prohibition against transmission does not even require that a physical copy of the performance ever be made. While this act appears to create an exception to the fixation requirement for copyright, it is probably best understood as an independent right that is similar to copyright, but is not copyright." source : link So what is your point? Any material that has been either published OR not published (as live material being bootleg recordings or demo's or outtakes) are subject to copyright! So your post does not make sense in any way. How can you set the rules of a website above national or international rules? I only responded because the original post is completely legally wrong! And still people take it as the "truth". Copyright infringment does probably depends per country, but my post does make sense for the majority of the people on Queenzone, unless other people can proof me otherwise (I am open for discussion!) Stefan PS see also: link PS2 If Queen Production is monitoring "us" then we are still lucky and "allowed" to do what we are doing ....So let's hope it will stay like this ... I just wanted to clear things legally .. PS3 We can keep things quiet as YV suggested, but we all need to be carefull anyway! |
